By accessing our website, browsing our products, placing an order or otherwise using our services, you agree to these Terms & Conditions.

We know. Terms and conditions aren't exactly thrilling reading. But neither is arguing over who said what later — so here we are.

Throughout these Terms, “UNSOCIAL ERA”, “we”, “us” and “our” refer to the business operating the UNSOCIAL ERA website and online store.

1. USING OUR WEBSITE

By using this website, you agree to use it only for lawful purposes and in a way that does not interfere with the operation, security or enjoyment of the website by others.

You must not:

  • Attempt to gain unauthorised access to our website or systems

  • Introduce viruses, malicious code or other harmful material

  • Use automated systems to scrape, copy or extract content without permission

  • Use our website or content for fraudulent or unlawful purposes

  • Reproduce or commercially exploit our content without permission

Basically, browse. Shop. Find something that perfectly describes your current level of social tolerance.

Just don't be weird about it.

2. PRODUCTS

We make reasonable efforts to ensure product descriptions, photographs, colours, sizing and other information displayed on our website are accurate.

However, colours may appear differently depending on your screen, device and display settings.

Because many of our garments feature relaxed, oversized or unisex fits, we strongly recommend checking the relevant size guide before ordering.

Product measurements may also vary slightly due to normal manufacturing tolerances.

3. PRODUCT AVAILABILITY

All products are subject to availability.

Having an item in your cart does not reserve it.

We may limit quantities, discontinue products or remove products from sale at any time.

And yes, sometimes the thing you've been thinking about for three days sells out while you're still thinking about it.

We can't help you there.

4. PRICING

All prices displayed on our Australian website are in Australian Dollars (AUD) unless otherwise stated.

Where applicable, prices include GST.

We reserve the right to change prices at any time without notice.

The price charged for an order will generally be the price displayed at checkout when your order is submitted, subject to correction of genuine errors.

Shipping charges, where applicable, will be displayed during checkout before payment is completed.

5. PRICING & WEBSITE ERRORS

Occasionally, a product may be listed with an incorrect price, description, promotion or other information due to human or technical error.

If we identify an obvious error after you place an order, we may contact you to explain the issue and provide available options.

Where permitted by law, this may include cancelling and refunding the affected item or order.

Nothing in this section limits any rights you may have under the Australian Consumer Law.

6. PLACING AN ORDER

When you place an order through our website, you are making an offer to purchase the products in your order.

Submitting payment or receiving an automated order confirmation does not necessarily mean your order has been accepted.

We reserve the right to decline or cancel an order where reasonably necessary, including where:

  • A product is unavailable

  • There has been a pricing or website error

  • Payment cannot be authorised

  • We reasonably suspect fraud or unauthorised activity

  • Incorrect customer or delivery information has been supplied

  • An order breaches purchase limits or promotion conditions

If we cancel an order after payment has been taken, we will refund the applicable amount using the original payment method where possible.

7. PAYMENT

Payment must be made using one of the payment methods available at checkout.

Your payment may be processed by a third-party payment provider, and additional terms from that provider may apply.

You agree that the payment information you provide is accurate and that you are authorised to use the selected payment method.

UNSOCIAL ERA does not generally store complete credit or debit card information.

8. SHIPPING & DELIVERY

Shipping options, estimated delivery timeframes and applicable charges will be displayed on our website or during checkout.

Delivery estimates are estimates only.

Once an order has been handed to the relevant postal or courier service, delivery may be affected by circumstances outside our reasonable control.

We will, however, assist where reasonably possible if something goes sideways.

Customers are responsible for providing a complete and accurate delivery address.

Additional costs resulting from an incorrect or incomplete address may be payable by the customer where permitted by law.

9. RETURNS, EXCHANGES & REFUNDS

Returns, exchanges and refunds are handled in accordance with our Returns & Exchanges Policy and your rights under the Australian Consumer Law.

Please choose carefully and review product sizing before ordering.

Change-of-mind returns are subject to the conditions stated in our Returns & Exchanges Policy.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded under the Australian Consumer Law.

10. FAULTY OR INCORRECT PRODUCTS

If your product arrives faulty, damaged, significantly different from its description or you receive an incorrect item, please contact us as soon as reasonably possible.

We may request photographs or other information to help us assess the issue.

Where the Australian Consumer Law applies, you may be entitled to a repair, replacement, refund or another remedy depending on the circumstances.

And no, we're not going to make you fight us over a hoodie that arrived with one sleeve.

11. CHANGE OF MIND

We understand.

You ordered it at 11:47pm.

It felt right at the time.

If you change your mind, any return or exchange will be handled according to our Returns & Exchanges Policy.

Change-of-mind returns are separate from your statutory rights relating to faulty or non-compliant products.

12. PROMOTIONS & DISCOUNT CODES

From time to time, we may offer discount codes, promotions, giveaways or special offers.

Unless otherwise stated:

  • Promotions cannot be combined

  • Discount codes must be entered before completing checkout

  • Discounts cannot generally be applied retrospectively

  • Promotions may have start and end dates

  • Some products may be excluded

  • Minimum purchase requirements may apply

  • Promotions are subject to stock availability

We reserve the right to amend, suspend or withdraw a promotion where reasonably necessary, including where there has been an error, misuse or circumstances outside our reasonable control.

13. GIFT CARDS

Where gift cards are offered, additional terms may apply.

Gift cards are not redeemable for cash except where required by law.

Expiry dates and other conditions will comply with applicable Australian laws.

Please treat gift cards like cash, because unfortunately “I put it somewhere safe” isn't a recognised payment method.

14. PRE-ORDERS

Some products may occasionally be offered for pre-order.

Estimated dispatch or availability dates for pre-order products are estimates and may change due to manufacturing, freight or other circumstances.

Where there is a significant delay, we will provide updates where reasonably practicable.

If your order contains both pre-order and in-stock items, those items may be shipped together or separately depending on the shipping information provided at the time of purchase.

15. INTELLECTUAL PROPERTY

Unless otherwise stated, all content appearing on the UNSOCIAL ERA website is owned by, licensed to or used with permission by UNSOCIAL ERA.

This includes, without limitation:

  • Brand names

  • Logos

  • Garment graphics

  • Statements and original creative designs

  • Artwork

  • Photography

  • Product descriptions

  • Website copy

  • Graphics

  • Layouts

  • Videos

  • Marketing materials

You may not reproduce, copy, modify, distribute, manufacture, sell or commercially exploit our intellectual property without prior written permission.

Our small statements might be small.

Our opinion about people copying them isn't.

16. USER-GENERATED CONTENT

If you tag UNSOCIAL ERA, send us photographs or otherwise provide content featuring our products, we may contact you to request permission to repost or use that content.

Where permission is granted, we may use the content for the purposes agreed with you.

We won't assume that tagging us automatically means you've signed away your firstborn and your photo rights.

17. REVIEWS

If you submit a product review, you agree that it reflects your genuine experience and does not contain unlawful, defamatory, abusive, misleading or infringing material.

We reserve the right to moderate or remove content where reasonably necessary.

We will not intentionally alter genuine reviews simply because someone didn't tell us we're fabulous.

18. THIRD-PARTY LINKS & SERVICES

Our website may contain links to third-party websites, platforms or services.

We are not responsible for the content, availability, security or privacy practices of third-party websites.

Your use of third-party services may be governed by their own terms and policies.

To the maximum extent permitted by law, UNSOCIAL ERA will not be liable for indirect, incidental, special or consequential loss arising from your use of our website or products.

Nothing in these Terms limits liability where doing so would be unlawful, including liability or remedies that cannot be excluded under the Australian Consumer Law.

To the extent permitted by law, you agree to indemnify UNSOCIAL ERA against reasonable loss, damage or costs resulting from your unlawful use of our website, infringement of another person's rights or material breach of these Terms.

We may update these Terms & Conditions from time to time to reflect changes to our website, products, business practices or legal obligations.

The latest version will be published on our website with the updated date shown at the top.

Your continued use of the website after changes are published will be subject to the updated Terms to the extent permitted by law.

24. GOVERNING LAW

These Terms are governed by the laws applicable in Victoria, Australia.

Any dispute relating to these Terms will be subject to the jurisdiction of the courts and tribunals of Victoria and any courts entitled to hear appeals from them, subject to any rights you may have under applicable consumer law.
